Terms & Conditions

These Terms and Conditions (“Terms”) govern your access to and use of whatittakesmovie.com (the “Site”) and the purchase of tickets to film screenings and related events operated by On the Brink Productions, LLC, a Washington limited liability company (“Company,” “we,” “us,” or “our”).

By accessing the Site, purchasing a ticket, or attending an event, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to purchase tickets. By placing an order, you represent that the information you provide is accurate and complete.

2. Tickets & Delivery

All tickets are delivered electronically to the email address provided at checkout. Tickets may be presented digitally or printed for entry.

You are responsible for:

  • Providing accurate contact information

  • Checking spam or junk folders

  • Safeguarding your ticket

Admission will be granted to the first valid ticket scanned. The Company is not responsible for lost, stolen, duplicated, altered, or fraudulently obtained tickets.

Tickets are transferable. The Company is not responsible for third-party resale transactions or disputes between private parties.

3. Event Modifications & Cancellations

The Company reserves the right to modify event dates, times, venues (within the same metropolitan area), programming, or format as necessary.

If an event is canceled and not rescheduled, the Company may issue a refund of the ticket purchase price. If an event is rescheduled, tickets will remain valid for the new date.

4. Refunds

Except where required by applicable law, ticket purchases are generally final.

Refund requests may be considered at the Company’s discretion but are not guaranteed. Failure to attend an event does not automatically entitle a purchaser to a refund.

5. Assumption of Risk

Attendance at a public event involves inherent risks. By attending, you voluntarily assume all risks associated with participation, including risks of personal injury, illness, property loss, or other harm.

6. Release & Limitation of Liability

To the fullest extent permitted by law, you release and hold harmless On the Brink Productions, LLC and its members, managers, officers, contractors, affiliates, and venue partners from claims arising out of or related to your attendance at an event or use of the Site, except in cases of gross negligence or willful misconduct.

IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

In all circumstances, the Company’s total liability shall not exceed the amount paid for the ticket giving rise to the claim.

7. Indemnification

You agree to indemnify, defend, and hold harmless the Company from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of:

  • Your violation of these Terms

  • Your conduct at an event

  • Your misuse of the Site

8. Binding Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY.

Any dispute arising out of or relating to these Terms, ticket purchases, event attendance, or use of the Site shall be resolved exclusively through final and binding arbitration conducted in the State of Washington.

You agree:

  • To waive any right to a jury trial

  • To bring claims only in your individual capacity

  • Not to participate in any class, collective, or representative action

Arbitration shall be conducted in accordance with applicable commercial arbitration rules. Each party shall bear its own attorneys’ fees unless otherwise awarded.

9. Chargebacks & Payment Disputes

If you believe there is an error regarding your purchase, you agree to contact the Company before initiating a chargeback with your financial institution.

Initiating a chargeback for a valid and authorized transaction may result in restriction of future purchases and recovery efforts to the extent permitted by law.

10. Force Majeure

The Company shall not be liable for delays, modifications, or cancellations caused by events beyond its reasonable control, including natural disasters, government orders, venue closures, labor disputes, power outages, or public health emergencies.

11. Website License & Use

The Site and all content are owned by the Company or its licensors and are protected by U.S. intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes.

You may not:

  • Copy, reproduce, distribute, or modify Site content

  • Use bots or automated systems to access the Site

  • Attempt unauthorized access

  • Interfere with Site security

  • Upload malicious code

We reserve the right to suspend or terminate access at our discretion.

12. Intellectual Property

All film materials, promotional content, logos, branding, text, graphics, and audiovisual materials are protected by copyright, trademark, and other applicable laws.

Unauthorized recording of any screening is strictly prohibited.

13. Digital Millennium Copyright Act (DMCA) Notice

If you believe copyrighted material has been posted on the Site without authorization, please send a written notice to:

Your notice must include:

  • Identification of the copyrighted work

  • Identification of the allegedly infringing material and its location

  • Your contact information

  • A statement under penalty of perjury that the information provided is accurate

  • Your physical or electronic signature

14. No Warranties

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

The Company makes no warranties regarding:

  • Site availability or uninterrupted access

  • Error-free operation

  • Correction of defects

  • Freedom from viruses or harmful components

Use of the Site is at your own risk.

15. Third-Party Links

The Site may contain links to third-party websites. The Company is not responsible for the content, policies, or practices of third parties.

16. Screening Packages

Custom or private screening packages are governed by separate written agreements. In the event of conflict, those agreements control.

17. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
